Please read everything. There's a lot of important info here.

- By commissioning me, you agree to the below terms, confirm you are familiar with the terms and with the consequences if you break these terms!- You also understand and confirm that failure to comply with these terms will result in you being blacklisted!
By commissioning me, you are agreeing to these Terms of Service.
These terms are subject to change as I see fit, at any time and without notice.
General
- Clients are not permitted, under any circumstances, to use their commissioned artwork for non fungible tokens. Use of the artwork for any advertising or profits associated with non fungible tokens or cryptocurrency is strictly prohibited. You will be blacklisted and I will seek legal action.- Clients are also not permitted to use my work for AI generation or anything of the sort. You will be blacklisted and other artists will be warned of your actions.- You MUST be 18 or older to commission me. Yes, even for sfw commissions. When you commission me, I assume in good faith that you are 18 or older. If I learn that you are lying about your age, you will be blacklisted!- All parties MUST consent to the content of the commission. (Exceptions being for gift art)- Anything not covered on here will be dealt with on a case by case basis and is fair to both parties.- I reserve the right to post one or all versions of the artwork that I create and use the full unwatermarked commission image as I see fit. This includes but is not limited to- for tutorial purposes, portfolio, advertisement, practice, usage in art packs, Ko-fi rewards, prints, etc.- I reserve the right to deny my services as I see fit.-You MUST provide me a clear visual reference of the character(s) UNLESS I am working on a character design! Clear visual references include: Reference sheets with flat coloring (no shading whatsoever) or existing art of a character(s). If you would like a character designed, please contact me about ordering a reference sheet.-The customer may make large changes to the piece (pose, composition, subject matter) at the sketch stage. Medium changes (anatomy/pose tweaks) at the line art stage and smaller changes (color/atmosphere) at the color/shading stage.-You will get three(3) chances to change anything about your piece without accruing an extra fee. All mistakes on my part will be corrected at any point in the piece. I will not make any edits past the color/shading phase (I.E: unless there was an error on my part). If you want any changes/edits past the color/shading phase, extra charges will accrue. I will not make last-minute changes to a completed piece! Please choose the hourly option if you feel you will need many opportunities to change the piece.
Hourly Commissions
-Payment for hourly pieces will be made after the project is complete.-Progress updates will be heavily watermarked.-I will give the customer a timestamp of the hours I have worked and a watermarked image with each update.-The customer may ask for as many changes as desired at any stage under the hourly rate.-Upon completion, you will be sent a watermarked and unwatermarked copy of the work via email, google drive, or discord once the final payment has been confirmed by me as received.If at any point you must cancel an hourly commission, I will send an invoice with the hours I have worked. Once that is paid, I will send a watermarked and unwatermarked file of what I have finished so far.
Payment and Refunds
PAYMENT
-After I accept your commission, you will send the payment through my KoFi. (My cashapp is for friends and people local to me for payment.) Other than what is listed above, I DO NOT accept payment through any other means.-Full payment is required before I begin any work.-Failure to pay within the given timeframe will result in cancellation of your commission and have the potential of being blacklisted.
PAYMENT PLANS
-Payment plans are only available on commissions worth 100 USD or more.-If you are struggling to pay, PLEASE reach out to me so we can discuss it! I am more than happy to work with my clients, I know sometimes things happen and life will throw things at you unexpectedly. You just need to communicate with me so we can work something out that is fair to both of us.
CANCELLATION/REFUNDS
I reserve the right to refund you for your commission and/or end the process of the artwork for any reason, at any time.-If I feel I cannot complete my client's commission within the given turnaround time, a full refund will be provided or if the client wishes, a new turnaround time will be negotiated.-If a client wishes to cancel their commission and NO WORK HAS BEEN STARTED, a full refund will be provided. If there is any work done at the time of cancellation, a partial refund may be provided.-Other than the reasons stated above, I DO NOT OFFER REFUNDS!
Artist Usage rights
-By commissioning me, you are purchasing my labor. I retain copyright over all my work, which includes but is not limited to the right to redistribute, reproduce, or reuse my work for marketing and self promotion, unless agreed upon beforehand.-I will respect your request to not publicly post your commission.-I reserve the right to redistribute my artwork for personal and commercial use unless agreed upon beforehand.-I reserve the right to modify and resell any rejected sketches as "pre-posed" or YCHs.
Client Usage rights
-Once your commission is complete, you will be given the watermarked full resolution and small resolution versions of your piece. The small res version has a larger watermark for public posting and sharing reasons.-You are ONLY allowed to repost the small res watermarked version(s) of your commission. The Full Res file(s) are reserved only for private use by the client.-You may use the full res for private use such as avatars, desktop images, icons, reference for future commissions, and other personal means.-The customer may not claim that my artwork was made by themselves or someone other than me.-The customer may make edits to the work I do for them but must credit me for the original work/design if they post their edited version.-The customer may not commercially redistribute copies of my art unless given explicit permission. The customer may NOT resell the work for reproduction or be used for business promotion unless explicitly given permission by me. This includes but is not limited to: prints, t-shirts, mugs, charms, etc.
CHARACTER DESIGNS
-The customer may use the character design I have made for them in commercial endeavors, such as novels, blogs, videos, and video games but must credit me for the design.-The customer may not claim a design I created was created by them unless significant changes have been made and I have approved it. Please contact me if you have made large changes to the design and wish to claim it as your own work.
PRIVATE COMMISSIONS
-Private Commissions will have a 75% fee added to them. This is to cover loss of ad revenue due to my inability to share the piece. (I.e. If your commission is 100 USD, you will pay 175 USD.) If you decide to post the commission in the future, the fee is non-refundable!-Pieces commissioned as a gift will not be charged a private fee as they are meant to be a surprise for the recipient of the piece.-All parties involved must be informed of these terms should they be included in said private commission.-If you would simply not like your username listed in the description, be sure to let me know beforehand in your form, as well, you will not be charged the private commission fee.
REVISIONS
-Revisions of your piece are most flexible during the sketch and line art stages. During the sketch stage I can do edits/changes until you are happy and approve to move forward with the line art stage. After the sketch stage you have three (3) freebies for edits/changes before you start to accrue fees for continuous edits/changes. You are more than welcome to switch to an hourly commission if you find yourself needing continuous edits/changes!-I HIGHLY ENCOURAGE you to point out any errors on my part. (Any mistakes made of my behalf, such as forgetting an accessory or getting a marking incorrect, will be fixed and will not be charged a fee) If you want something changed, PLEASE DO NOT HESITATE TO TELL ME!-Please note, requesting major changes for things that were not present on the reference, discussed before starting the commission, or were missed by you during the sketch approval, will cost an additional charge after your 3 freebies.-PLEASE condense revision requests into as few messages and as many details as possible! I am Autistic and have ADHD, I work best with as many details as possible and condensing the messages also helps me keep things organized. :)
(ie: send one message asking to change the expression, tail, and paws; not one message for each thing to be changed).-Once the final version of your commission has been approved, I will not make any more changes.
I may make an exception if it is a very minor fix or it was something forgotten/missed on my part.
Redlining
I accept redlining as a form of communication! Especially if you feel you don't have the words or don't know how to describe the changes you want to make.I highly encourage redlining! For example; if you desire something on the image to be bigger or smaller or want the character's tail a certain way, a redline is great way to communicate that with me. Redlining also saves us a lot of back and forth on the small simple things.
Characters
-Owner(s) of the character(s) being presented in the image must agree to the commission purchased. Exceptions are made for gifts/surprise commissions.
If the commission is a surprise gift for a friend or partner, please let me know ahead of time so I can keep it a secret until it is ready for you to surprise them with!-Character(s) must fall within my will/won’t draw guidelines in order for the commission process to continue. Please note, if I find out that you are abusing this exception or feel that the subject matter may be concerning in some way, I will deny the commission.
REFERENCES
-Please include proper references for your character(s) that clearly show what you want (skin color, fur color, height, hairstyle, etc)! It is your job to provide an accurate reference for me to use for your commission.-Incomplete or heavily shaded references will be declined.-I am not at fault for any inaccuracies or missing markings/features should you provide improper references or your character is difficult to decipher. Also, if a color for a detail is not given, I may pick one for you (ie: mouth detail, paw pad color, nails, etc.) or ask you to pick a color.-If something is missing that is not specified in your reference(s) OR in your commission description, I will not change it without a fee, so PLEASE double check that you have provided me with all the proper references.-Please provide a clear reference of your character's parts if requesting NSFW themes.-I do not work from written descriptions unless the design is very simple.
Turnaround time
-Commission timeframes varies from 2 weeks to 3 months depending on the content, queue size and my main job schedule.-COMMUNICATION IS KEY! If communication is kept up between both parties at a quick or reasonable pace, your commission may be completed sooner.-If you are farther down in my queue, your piece could take longer. Also keep in mind that more complicated pieces or large image sets may also take longer. I will do my best to keep in contact and let you know of any changes in my schedule or events that may affect your commission.- I do not work with deadlines. I have a full time job (thankfully I can pick and choose my hours/days I work) and I am disabled, which means am in and out of the hospital/doctor's office. This also means I can't guarantee that the deadline will be met. I try my best to stay within the 2 week to 3 month turnaround time and I will communicate to you if my schedule or events conflict with that turnaround time. That way we can discuss a game plan or if a refund is in order. (My only exceptions to this is are a rush fee OR if it's for a birthday or anniversary gift! For gifts I require at minimum it be 1 month in advance.)-WIPs will be provided when available but the client may ask for updates at any time.-While progress may or may not have been made, the status of your piece will be kept on my Trello as well as communicated with you beforehand.
